APPEAL FROM THE THIRD CIRCUIT COURT
(S.P. NO. 92-043K and M.L. NO. 92-011K)

ORDER DISMISSING APPEAL
(By: Moon, C.J., Levinson, Nakayama, Ramil, and Acoba, JJ.)

Upon review of the record, it appears that Appellant failed to take action necessary to the filing of the record on appeal after the bankruptcy stay was terminated in December 1993 and was ordered to show cause why this appeal should not be dismissed for lack of prosecution. The response by Appellant's counsel indicates that Appellant has abandoned this appeal. Therefore,

IT IS HEREBY ORDERED that this appeal is dismissed.

DATED: Honolulu, Hawaii, May 15, 2002.
