NO.
19227
IN
THE SUPREME COURT OF THE STATE OF HAWAI`I
OFFICE
OF DISCIPLINARY COUNSEL, Petitioner,
vs.
JAMES
C. BEAMAN, Respondent.
(ODC
03-240-7840)
ORDER OF SUSPENSION
(By: Moon, C.J., Levinson, Nakayama, Acoba, and Duffy, JJ.)
Upon consideration of the Office of Disciplinary Counsel's petition for
the
immediate suspension of Respondent James C. Beaman from the practice of
law,
pursuant to Rule 2.12A of the Rules of the Supreme Court of the State
of Hawai`i
("RSCH"), for failure to cooperate with the investigation of a
disciplinary
matter, Respondent Beaman's May 20, 2004 Response By Way of Memorandum
and
Affidavit to "Order to Show Cause," Respondent Beaman's April 24, 2004
"Response
to Petition for the Immediate Suspension of Respondent From the
Practice of Law
Pursuant to RSCH 2.12A[,]" the Office of Disciplinary Counsel's May 10,
2004 Reply
to Respondent's Response By Way of Memorandum and Affidavit to "Order
to Show
Cause[,]" and the record, it appears that: (1) Respondent Beaman is the
subject
of a disciplinary investigation by Disciplinary Counsel; (2) although
Respondent
Beaman was not officially served with our May 10, 2004 order to show
cause until
June 1, 2004, Respondent Beaman filed responses to our May 10, 2004
order on May
20, 2004 and April 26, 2004; (3) Respondent Beaman has not fully
complied with
Disciplinary Counsel's requests and thus, has failed to cooperate with
Disciplinary Counsel's investigation; and (4) Respondent Beaman has
failed to show
good cause for such failure. Respondent Beaman, having failed to fully
cooperate
with Disciplinary Counsel's investigation and having failed to show
good cause for
his failure to fully cooperate with the disciplinary investigation is,
therefore,
guilty of failing to cooperate with the disciplinary investigation.
Therefore,
IT IS HEREBY
ORDERED, pursuant to RSCH 2.12A, that Respondent James C. Beaman is
suspended from the practice of law in this jurisdiction, effective
immediately and
until further order of this court.
DATED: Honolulu,
Hawai`i, June 14, 2004.
