ORDER DENYING MOTION FOR RECONSIDERATION

Upon consideration of "Respondent's Request by Way of Memorandum and Affidavit for Vacation of this Court's 'Order of Suspension' Dated June 14, 2004[;]" which we treat as a motion for reconsideration made pursuant to Rule 40 of the Hawai`i Rules of Appellate Procedure, and the record,

IT IS HEREBY ORDERED that the motion for reconsideration is denied without prejudice to Respondent Beaman filing a subsequent motion to vacate this court's Order of Suspension, dated June 14, 2004, which is supported by an affidavit or declaration of an authorized representative of the Office of Disciplinary Counsel ("ODC") attesting to Respondent Beaman's satisfactory cooperation with ODC's investigation or disciplinary proceeding.
