IT IS HEREBY ORDERED that the published order filed on April 29, 1999 is amended as follows (bracketed portions of text are deleted; underlined portions are added):

1. The caption on page 1 is amended as follows:

2. The second paragraph on page 2 is amended to read:

IT IS HEREBY ORDERED that the ICA's conclusion (1) and the ICA's instruction to remand for a new [trial] hearing are reversed.

3. Footnote 1, line 1, on page 2 is amended as follows:

By letter dated June 17, 1998, Defendant [Calvin] Cavin C. Desmond's attorney

IT IS FURTHER ORDERED that the Clerk of the Court shall incorporate the foregoing changes in the original order.
