ORDER AMENDING OPINION OF THE COURT

AND CIRCUIT COURT JUDGE WEIL, IN PLACE OF RAMIL, J., RECUSED



The opinion of the court, filed on November 17, 1998, is hereby amended as follows:

1. On page four, the third paragraph, lines two and three, is amended as follows (words deleted are in brackets, words added are underlined):

"discretion in failing to award prejudgment interest to GBC [from the time of] with respect to the damages resulting from the conversion of Roxas's property. Therefore, we".

2. On page thirty-two, footnote eleven should read:

11 GBC first sought to institute probate proceedings for the Marcos Estate in 1990, but its petition was denied by the first circuit court. See In re Estate of Marcos, 88 Hawai`i at 151, 963 P.2d at 1127. Its motion for reconsideration was also denied. See id. at 151 & n.1, 963 P.2d at 1127 & n.1. A 1995 pleading "again attempted to open a probate proceeding in Hawai`i" and requested that Silverman be appointed personal representative of the estate. See id. at 152, 963 P.2d at 1128. Finally, in 1996, Silverman petitioned the probate court for appointment as special administrator of the Marcos Estate. That petition was also denied. See id. at 153, 963 P.2d at 1129. On appeal, this court affirmed the probate court's orders. Id. at 158-59, 963 P.2d 1134-35.



3. On page ninety-one, the first paragraph, line eleven should read as follows:

"Estate of Marcos, 88 Hawai`i at 154-55, 963 P.2d at 1130-31 (holding".

4. On page one hundred thirty-six, section heading "2." should read as follows:

2. The circuit court committed an abuse of

discretion by failing to award GBC prejudgment

interest with respect to GBC's damages resulting

from the conversion.



The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion.
