APPEAL FROM THE LABOR AND INDUSTRIAL RELATIONS APPEALS BOARD

(CASE NO. AB 2000-099(H) (1-96-00509))

ORDER DISMISSING APPEAL

(By: Moon, C.J., Levinson,

Nakayama, Ramil, and Acoba, JJ.)

Upon review of the statements supporting and contesting jurisdiction and the record, it appears that: (1) the May 11, 2000 order granting the stay of worker's compensation benefits is a pretrial order that does not finally end the proceeding before the labor appeals board and deferring review of the order pending entry of a final decision by the appeals board will not deprive Appellant of adequate relief; and, thus, (2) we lack jurisdiction over this appeal. HRS §§ 91-14(a) and 386-88. Therefore,

IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction.

DATED: Honolulu, Hawaii, October 19, 2000.
