APPEAL FROM THE LABOR AND INDUSTRIAL RELATIONS APPEALS BOARD

(CASE NO. AB 97-030(H) (1-91-02784))

ORDER DISMISSING APPEAL

(By: Moon, C.J., Levinson, Nakayama,

Ramil, and Acoba, JJ.)

Upon review of the record, it appears that this court informed Appellant Nancy D. Makanui by letter dated January 22, 2001, that the time for filing the statement of jurisdiction expired on December 9, 2000 and the time for filing the opening brief expired on January 8, 2001 and, that, pursuant to Rule 30 of the Hawaii Rules of Appellate Procedure, the matter would be called to the attention of the court for such action as the court deemed proper. Appellant has not filed the statement of jurisdiction and opening brief; therefore,

IT IS HEREBY ORDERED that the appeal is dismissed.

DATED: Honolulu, Hawaii, February 6, 2001.
