IN THE SUPREME COURT OF THE STATE OF HAWAII
PAUL KENNETH GRUBB, Plaintiff-Appellant
vs.
STATE OF HAWAII, DEPARTMENT OF
PUBLIC SAFETY, Defendant-Appellee
APPEAL FROM THE FIRST CIRCUIT COURT
(CIV. NO. 99-3446)
ORDER DISMISSING APPEAL
(By: Moon, C.J., Levinson,
Nakayama, Ramil, and Acoba, JJ.)
Upon review of the record, it appears that: (1) final judgment has not been entered in Civil No. 99-3446; (2) the appeal of the October 9, 2000 and December 1, 2000 orders is an appeal of interlocutory orders that were not certified for interlocutory appeal; and thus, (3) this appeal is premature and we lack jurisdiction. See HRS § 641-1(a). Therefore,
IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction.
DATED: Honolulu, Hawaii,
April 17, 2001.
