It appearing from the record that: (1) the Intermediate Court of Appeals filed its memorandum opinion in the above-captioned matter on February 8, 2002, affirming the judgment of the circuit court; (2) the notice and judgment on appeal was filed on May 13, 2002; (3) defendant-appellant Joseph R. Thames's "notice of appeal," which this court deems an "application for writ of certiorari," was filed on June 12, 2002; and (4) the application is untimely, see Hawai`i Revised Statutes § 602-59(c); see also Hawai`i Rules of Appellate Procedure Rule 40.1(a) (2000), therefore,
IT IS HEREBY ORDERED that the "application for writ of certiorari" is dismissed for lack of appellate jurisdiction.
