Smith to (1) serve a copy of the opening brief on counsel for appellee, and (2) respond to the order to show cause in a timely manner. The order also informed appellant that failure to file a response or to show good cause would result in sanctions, which may include the dismissal of the appeal. Appellant having failed to serve a copy of the opening brief on counsel for appellee and having failed to file a response to the order to show cause in a timely manner,

IT IS HEREBY ORDERED that the appeal is dismissed.
