In accordance with Hawai`i Rules of Appellate Procedure Rule 35, and after carefully reviewing the record and the brief submitted by Defendant-Appellant Mary Lou French, and duly considering and analyzing the law relevant to the arguments and issues,
IT IS HEREBY ORDERED that the May 31, 2001 order of the family court
of the second circuit (the court), (1)
from which the appeal is taken, is vacated, inasmuch as the court did not
indicate the federal statutory authority for its order demanding that the
Federal Bureau of Investigation or other federal agency "turn over all
of Mary Lou French's assets which are presently in the FBI's or other agency's
possession to the Clerk of the Second Circuit Court," or establish that
it complied with the procedures and conditions set by Congress when rendering
