Upon consideration of Plaintiff/Counterclaim Defendant-Appellee Association of Apartment Owners of Maalaea Kai., Inc.'s motion to dismiss the appeal of Defendant/Counterclaimant-Appellant Michael Frederick Nason for failing to file briefs in conformity with the rules of appellate procedure, the papers in support, and the records and files herein, it appears that this appeal was dismissed on March 15, 2002 for lack of appellate jurisdiction, and the instant motion is moot. Therefore,

IT IS HEREBY ORDERED that the motion is dismissed as moot.
