Upon consideration of petitioner-appellant's "Reconsideration of Supreme Court Decision," filed January 16, 2004 and it appearing that (1) a motion for reconsideration of this court's December 22, 2003 opinion was due no later than January 2, 2004, (2) the notice and judgment on appeal was filed on January 7, 2004, and (3) petitioner-appellant's request for an extension of time was dismissed on January 12, 2004,

IT IS HEREBY ORDERED that the "Reconsideration of Supreme Court Decision" is dismissed. See Hawai`i Rules of Appellate Procedure Rule 40(a); State v. Harrison, 95 Hawai`i 28, 30, 18 P.3d 890, 892 (2001) (stating that, once the judgment on appeal is filed, appellate jurisdiction ordinarily terminates).
