APPEAL FROM THE FIRST CIRCUIT COURT
(CIV. NO. 01-1-2106)

ORDER DISMISSING APPEAL
(By: Moon, C.J., Levinson, Nakayama, Ramil, and Acoba, JJ.)

Upon review of the record, it appears that the July 22, 2002 notice of appeal was prepared, signed and filed by Dr. David Ben-Chayil KCR on behalf of appellant Oliver Vladimir Kozlik. Ben-Chayil is not an attorney licensed to practice law in Hawai`i and he cannot represent Kozlik before the supreme court. See Hawai`i Revised Statutes §§ 605-2 and 605-14; Oahu Plumbing and Sheet Metal, Ltd. v. Kona Construction, Inc., 60 Haw. 372, 376-377, 590 P.2d 570, 574 (1979) ("natural persons . . . are permitted . . . to appear pro se[;] nevertheless, . . . such natural persons are not permitted to act as 'attorneys' and represent other natural persons in their causes."). Thus, the July 22, 2002 notice of appeal is invalid. Therefore,

IT IS HEREBY ORDERED that this appeal is dismissed.

DATED: Honolulu, Hawai`i, November 8, 2002.
