Upon review of the concurring opinion by Acoba, J., filed with the Opinion herein on May 30, 2003, it appears that there is an error in footnote 5, therefore,

IT IS HEREBY ORDERED that the citation to State v. Matyas, contained in the last two lines of footnote 5 of the concurring opinion, shall be corrected as follows (deletions are bracketed; additions are double underlined):

State v. Matyas, 10 Haw. App. [148, 158] 31, 38, 859 P.2d 1380, 1384 [861 P.2d 759, 765] (1993).

IT IS HEREBY ORDERED that the clerk of the court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of these changes.
