ORIGINAL PROCEEDING
(Petition for Writ of Habeas Corpus)

ORDER
(By: Moon, C.J., Levinson, Nakayama,
Ramil, and Acoba, JJ.)

Upon consideration of Petitioner Terrence Cenido's petition for a writ of habeas corpus, the papers in support, and the records and files herein, it appears that: (1) Petitioner alleges that the sentences imposed in Cr. No. 97-1986, Cr. No. 99-2101, and Cr. No. 00-1-2059 are illegal; (2) Petitioner has a pending appeal from an order denying his motions to correct illegal sentences (Appeal No. 25305); and (3) Petitioner can appeal from the circuit court order denying his petition for post conviction relief. Therefore,

IT IS HEREBY ORDERED that the petition for a writ of habeas corpus is denied without prejudice to any remedy Petitioner may have by way of appeal.

DATED: Honolulu, Hawai`i, November 6, 2002.
