NO. 25483

IN THE SUPREME COURT OF THE STATE OF HAWAI`I

HARRY K. PILTZ, JR., and MARY WIGHT PILTZ, Plaintiffs-Appellees

vs.

HON/HAWAII SERVICES, INC., Defendant-Appellant

APPEAL FROM THE DISTRICT COURT OF THE FIRST CIRCUIT
(CIVIL NO. 1RC00-7936)

ORDER DISMISSING APPEAL
(By: Moon, C.J., Levinson, Nakayama, and Acoba, JJ.
and Intermediate Court of Appeals Chief Judge Burns,
assigned by reason of vacancy)

Upon review of the statements supporting and contesting jurisdiction and the record, it appears that Civil No. 1RC00-7936 remains pending before the district court for adjudication of the plaintiffs' claim for damages. The July 18, 2002 and October 15, 2002 orders did not end the litigation in Civil No. 1RC00-7936 and the appeal of the orders is premature. See HRS § 641-1(a); Casumpang v. ILWU, 91 Hawai'i 425, 984 P.2d 1251 (1999). Therefore,

IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction.

DATED: Honolulu, Hawai`i, February 21, 2003.
