NO. 25728
IN THE SUPREME COURT OF THE STATE OF HAWAI`I
ANTHONY K. KEKONA, JR., Appellant-Appellant
vs.
STATE OF HAWAII, DEPARTMENT OF PUBLIC SAFETY and ALBERT
MURASHIGE, Appellees-Appellees
APPEAL FROM THE SECOND CIRCUIT COURT
(CIV. NO. 03-1-0101)
ORDER DISMISSING APPEAL
(By: Moon, C.J., Levinson, Nakayama, Acoba, and Duffy, JJ.)
Upon review of the record, it appears that the March 11, 2003 decision denying appellant a hearing in Civil No. 03-1-0101 is appealable upon entry of a final judgment disposing of Civil No. 03-1-0101, but final judgment has not been entered. Thus, the appeal of the March 11, 2003 decision is premature and we lack jurisdiction. See HRS § 641-1(a). Therefore,
IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction.
DATED: Honolulu, Hawai`i, July 28, 2003.
