Upon review of the Opinion of the court filed on August 25, 2004, it appears that there is an error in the date of the third circuit court's order granting Plaintiff-Appellee's motion for summary judgment on page 14, Section VIII., of the opinion. Therefore,

IT IS HEREBY ORDERED that the said opinion is corrected by striking "29" and inserting "20" on the first line in Section VIII. of the opinion so that the line reads:
