Upon review of the opinion filed in this case on August 5, 2004, it appears that footnote 6 contains an error. Therefore,

IT IS HEREBY ORDERED that line 4 of footnote 6 on page 15 of the opinion is corrected by inserting the correct pinpoint citation to State v. Higa, so that the line reads:

222; see Higa, 102 Hawai`i at 187, 74 P.3d at 10; Crail, 97 Hawai`i at 180, 35

The clerk of the court is directed to incorporate the foregoing change on the original opinion and take all necessary steps to notify the publishing agencies of the change.
