NO. 26194

IN THE SUPREME COURT OF THE STATE OF HAWAI`I

JANE DOE, Petitioner-Appellant

vs.

JOHN DOE and CHILD SUPPORT ENFORCEMENT AGENCY,
STATE OF HAWAI`I, Respondents-Appellees

APPEAL FROM THE FAMILY COURT OF THE FIRST CIRCUIT
(FC-P NO 02-1-0322)

ORDER DENYING MOTION FOR RECONSIDERATION
(By: Moon, C.J., Levinson, Nakayama, Acoba, and Duffy, JJ.)

Upon consideration of Petitioner-Appellant Jane Doe's motion for reconsideration of the order entered August 6, 2004, the papers in support, and the records and files herein, it appears that: (1) Appellant seeks transcripts at no cost and copies of court minutes relied upon by Appellee's counsel in preparing findings of fact and conclusions of law; (2) as Appellant notes, the August 6, 2004 order stated incorrectly that the family court granted Appellant's request for transcript at no cost; (3) review of the family court record confirms Appellant's statement that the family court denied Appellant's motion for free transcripts on appeal; (3) Appellant fails to show that the family court erred by denying the request; (4) all court minutes are appended to the family court record that is on file in the supreme court clerk's office and is available for Appellant to review; and (5) counsel for Appellee was able to obtain the relevant transcripts for the appeal; thus, Appellant should also be able to obtain all transcripts. Therefore,

IT IS HEREBY ORDERED that the motion for reconsideration is resolved as follows: (1) the request for free transcripts on appeal is denied; (2) the request that all documents be provided to Appellant is denied as unnecessary as all documents in the record on appeal are available for viewing in the supreme court clerk's office; (3) Appellant's request for an extension of time to file the opening brief is granted, and Appellant shall file her opening brief by September 15, 2004; and (4) the clerk of the family court shall supplement the record on appeal with all transcripts presently on file in the underlying family court case or within ten days after the transcripts are filed in the case.

DATED: Honolulu, Hawai`i, August 26, 2004.

Jane Doe, petitioner-
appellant, pro se, on
