IT IS HEREBY ORDERED that pursuant to HRAP 40(d), Cross Appellant's motion for reconsideration, requesting that this court review its order filed on November 8, 2004, permitting Cross-Appellant to file an opening brief not to exceed 40 pages, is hereby denied.
