vs.

STATE ATTORNEY GENERAL, STATE OF HAWAI`I AND ITS JUDICIARY,
Respondent

ORIGINAL PROCEEDING

ORDER
(By: Moon, C.J., Levinson, Nakayama, Acoba, and Duffy, JJ.)

Upon consideration of Petitioner Robin M.S. Lee's petition, it appears that: (1) on June 22, 2004, the supreme court filed a document titled "Petition" in which Petitioner Lee asks the court to dismiss all sentences imposed against him by Judge Michael A. Town in 1999 and 2001 and expunge his criminal record; (2) on June 22, 2004, the supreme court clerk's office sent a letter to Petitioner Lee informing him that he did not include a filing fee or a motion to proceed in forma pauperis and that the matter would be brought to the attention of the court for such action as the court deems appropriate and the proceeding may be dismissed; (3) the letter was sent to the address provided by Petitioner Lee, but it was returned by the post office with a notation that Petitioner Lee was not at that address; and (4) Petitioner Lee did not pay the filing fee or move to proceed in forma pauperis or take any other steps to pursue this matter. Therefore,

IT IS HEREBY ORDERED that Petitioner Robin M.S. Lee's petition is dismissed.

DATED: Honolulu, Hawai`i, July 26, 2004.
