IT IS HEREBY ORDERED that the opinion of the court filed on January 29, 2001, is amended as follows:

Page 16, second line, in the cite to Friedman, P.3d shall be changed to P.2d so that the cite shall read: Friedman, 93 Hawaii at 72, 996 P.2d at 277.
 

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
