ORDER OF AMENDMENT

The memorandum opinion of the court, filed May 9, 2001, in the above-entitled case is hereby amended as follows: At page 11, the first name of counsel for Defendant-Appellant is amended from "Burton" to "Berton", so that the full name reads "Berton T. Kato".

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
