In the above-entitled appeal, the Memorandum Opinion of the court, filed June 25, 2001, is hereby amended as follows: In the case name of the caption, delete "Plaintiff-Appellant" and replace with "Plaintiff-Appellee"; and delete "Defendant-Appellee" and replace with "Defendant-Appellant", so that the case name reads:
