Upon consideration of the request for fees and expenses submitted by Appellant's counsel, Alan G. Warner, on October 25, 2001, pursuant to Hawai`i Revised Statutes § 802-5, the attachments thereto, and the record, it appears that expenses in the amount of $43.56 are reasonable and that attorney's fees in the amount of $2,944.00 are reasonable. It further appears that the amount of time expended on the case was necessary to provide adequate representation and the amount of the fee requested in excess of the statutory minimum is appropriate. Therefore,
IT IS HEREBY ORDERED that expenses in the amount of $43.56 are approved.
IT IS FURTHER ORDERED that the excess payment is certified as necessary to provide fair compensation and attorney's fees in the amount of $2,944.00 are approved.
