In the above-entitled appeal, the memorandum opinion of the court, filed September 14, 2001, is hereby amended as follows: At page 11, first full paragraph, line 1, the name "Dr. Steven J. Choy, M.D." is corrected so that line 1 reads as follows:

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
