IT IS HEREBY ORDERED that the opinion of the court filed on December 21, 2004, is amended as follows:

Page 14, fourth line: 418 N.E.2d 1343 should read 481 N.E.2d 1343.

Page 15, footnote 7: 803(a)(2)(c) should read 803(1)(2)(C).

Page 17: instead of 39 Fed. Cl. 442, the cite for Glendale Fed. Bank, FSB v. United States should read 39 Fed. Cl. 422.

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
