In the above-entitled appeal, the memorandum opinion of the court, filed May 1, 2002, is hereby amended as follows: In the caption, where the case name reads, "STATE OF HAWAI`I, Plaintiff-Appellant, v. EUGENE P. GORDON, Defendant-Appellee," "Plaintiff-Appellant" is deleted and replaced with "Plaintiff-Appellee" and "Defendant-Appellee" is deleted and replaced with "Defendant-Appellant" so that the case name reads as follows:

EUGENE P. GORDON, Defendant-Appellant

The clerk of the court is directed to incorporate the foregoing changes in the original opinion.
