IT IS HEREBY ORDERED that the opinion of the court filed on November 29, 2002, is amended by changing the caption on page 1 so that State of Hawai`i shall become "Plaintiff-Appellant" and Harvey Ababa shall become "Defendant-Appellee" and the caption reads as follows:

HARVEY ABABA, Defendant-Appellee,
and RODRIGO Ababa, Defendant

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
