In the above-entitled appeal, the memorandum opinion of the court, filed December 3, 2002, is hereby amended as follows: At page 3, line 15 from the top, the misspelled name "Rafetto" is deleted and replaced with the name "Raffetto" so that line 15 from the top of page 3 reads:

Raffetto entered "Findings of Fact, Conclusions of Law, and Order

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
