         IT IS HEREBY ORDERED that the opinion of the court filed on October 14, 2004, is amended by deleting the word

"FIRST" from "APPEAL FROM THE FIRST CIRCUIT" in the caption on page 1 and substituting the word "SECOND" so

the line becomes "APPEAL FROM THE SECOND CIRCUIT."

         The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps

to notify the publishing agencies of this change.
