ORDER OF AMENDMENT

In the above-entitled appeal, the memorandum opinion of the court, filed on December 24, 2003, is hereby amended as follows:

At page 24, last line, the word "states:" is inserted after the case name "Jackson". The sentence will thus read: "As noted above, this court's opinion in Jackson states:"

At page 37, at line 6 of item 3 of the Conclusions of Law, the Kawamata citation is amended to read as follows: "Kawamata Farms v. United Agri Products, 86 Hawai`i 214, 252, 948 P.2d 1055, 1093 (1997)(citations omitted)(brackets omitted)."

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
