On July 14, 2004, Respondent-Appellant Gwen Bittan filed a "Motion for Time Extension and Reconsideration Under Rule 40."

Respondent-Appellant's motion is untimely filed and, for that reason, cannot be considered by this court.

IT IS HEREBY ORDERED that the motion is denied.
