In the above-entitled appeal, the memorandum opinion of the court, filed July 23, 2004, is hereby amended as follows: On page 11, lines 7 and 8 of the first full paragraph, the word "[sic]" should be inserted after "HRS § 291-4(1)(a)" and "§ 291-4(1)(b)" so that it reads:

[sic] pled no contest to a DUI charge pursuant to HRS § 291-4(1)(a) [sic] or § 291-4(1)(b) [sic]. . . . Thus, because the trial court did
