In the above-entitled appeal, the opinion of the court, filed on July 30, 2004, is hereby amended as follows:

At page 2, line six from the top, the section "709-606" is amended to read "709-906". The full section would thus read: Hawaii Revised Statutes (HRS) § 709-906 (Supp. 2003).

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
