In the above-entitled appeal, the opinion of the court, filed on December 3, 2004, is hereby amended as follows: On page 11, line 7, appellant's name should be changed from "Tanka's" to "Tanaka's". The line should read: "further action regarding its cancellation of Tanaka's lease . . . ."

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
