IT IS HEREBY ORDERED that the Memorandum Opinion of the court filed on February 9, 2005, is amended on page 12 by substituting Artemio C. Baxa as counsel for Plaintiff-Appellee, State of Hawai`i in place of J. Kevin Jenkins.

The Clerk of the Court is directed to incorporate the foregoing change in the original memorandum opinion.
