THE INTERMEDIATE COURT OF APPEALS
OF THE STATE OF HAWAI`I
STATE
OF HAWAI`I, Plaintiff-Appellee, v.
JASMINE KAHEPUU, Defendant-Appellant
APPEAL
FROM THE FAMILY COURT OF THE FIFTH CIRCUIT
(FC-CR. NO. 02-1-0231)
SUMMARY DISPOSITION
ORDER
(By: Watanabe, Acting C.J., Lim and Fujise, JJ.)
Jasmine Kahepuu (Kahepuu) appeals the March 10, 2003 judgment of the
family court
of the fifth circuit, the Honorable Calvin K. Murashige, judge
presiding, that
convicted her of abuse of a family or household member, a violation of
Hawaii
Revised Statutes (HRS) § 709-906(1) (Supp. 2001). Kahepuu contends
the family
court erred in finding her guilty, because her use of force was
justified as
"parental discipline." After a diligent review of the record and the
briefs
submitted by the parties, and giving careful consideration to the
arguments
advanced and the issues raised by the parties, we disagree with
Kahepuu, and
affirm.
DATED: Honolulu,
Hawai`i, August 6, 2004.
On the briefs:
Jon N. Ikenaga,
Deputy Public
Defender, State of Hawai`i, for
defendant-appellant.
Tracy Murakami,
Deputy Prosecuting Attorney,
County of Kauai, for
plaintiff-appellee.
