IT IS HEREBY ORDERED that the Summary Disposition Order of the court filed on February 4, 2005, is amended on page 2 by substituting Daniel H. Shimizu as counsel for Respondent-Appellee State of Hawai`i in place of Alexa D.M. Fujise.

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion.
