On April 25, 2005, Defendant-Appellant George Gary Peabody (Peabody) filed a "Petition to Reconsider and Reverse the Summary Disposition Order," which this court shall treat as a motion for reconsideration of its April 7, 2005 Summary Disposition Order. Upon this court's consideration of Peabody's motion for reconsideration and the records and files in this case, IT IS HEREBY ORDERED that the motion is denied as untimely pursuant to Hawai`i Rules of Appellate Procedure Rule 40.
