ORDER OF AMENDMENT
(By: Burns, C.J., Watanabe and Nakamura, JJ.)

1.     Due to a printing error, the printed version of the opinion of the court, which was filed on March 24, 2005, skips from footnote 2 to footnote 4. The printed version of the opinion is hereby amended by renumbering footnotes 4 though 14 as footnotes 3 through 13 in both the text and the footnote. Thus, footnote 4 should be renumbered as footnote 3, footnote 5 should be renumbered as footnote 4, and so forth in the printed version. This footnote-numbering amendment only applies to the printed version of the opinion that was filed. The footnotes in the electronic version of the published opinion that was submitted are correctly numbered and therefore no changes in footnote numbering should be made to the electronic version.

2.     Both the printed and electronic versions of the opinion are amended to correct the following errors:

a.     On page 24, footnote 6 of the pre-amended printed version (which is footnote 5 of the electronic version), line 2 of the footnote, the word "Coral" is misspelled and should read "Corral."

b.     On page 26, footnote 7 of the pre-amended printed version (which is footnote 6 of the electronic version), line 13 of the footnote, the word "on" should be replaced with "for," and the corrected phrase should read "there to execute arrest warrants for his girlfriend."

3. The attorney credit section on the printed and electronic versions of the opinion is amended as follows:

a.     On page 36, line 5, the phrase "On the briefs:" should be deleted.

b.     On page 36, the attorney credit for Plaintiff-Appellee should be replaced with:

    (Arleen Y. Watanabe on the
    answering brief),
    Deputy Prosecuting Attorneys,
    County of Maui,
    for Plaintiff-Appellee.
