IT IS HEREBY ORDERED that the opinion of the court filed on November 16, 2005, is amended by adding "aff'd, 692 F.2d 595 (9th Cir. 1982)," after the cite "Mayo v. Attorney General, 528 F. Supp. 833 (D. Hawai`i 1981)" on page 20 of the opinion.

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
