IT IS HEREBY ORDERED that the opinion of the court filed on December 21, 2005, is amended on page 2, footnote 2, first paragraph, sixth line, by deleting "Stanley's" and replacing it with "Ermocida's".

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
