IT IS HEREBY ORDERED that the Summary Disposition Order of the court filed on July 15, 2005, is amended by deleting the State of Hawaii's designation as "Plaintiff-Appellee" in the caption of the case and replacing it with "Respondent-Appellee."

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion.
