IN THE INTERMEDIATE COURT OF APPEALS

OF THE STATE OF HAWAI`I

STATE OF HAWAI`I, Plaintiff-Appellee, v.
KURT BUTLER, Defendant-Appellant

APPEAL FROM THE DISTRICT COURT OF THE SECOND CIRCUIT
(CASE NOS.: CT2-CT3:5/7/04)

SUMMARY DISPOSITION ORDER
(By: Watanabe, Acting C.J., Lim and Nakamura, JJ.)

Kurt Butler (Butler) appeals the two May 7, 2004 judgments of the District Court of the Second Circuit (district court), the Honorable Jan K. Apo presiding, that convicted him of harassment and criminal property damage in the fourth degree, respectively.

After a meticulous review of the record and the briefs submitted by the parties, and giving careful consideration to the arguments advanced and the issues raised by the parties, we hold that there was substantial evidence to support the convictions. State v. Pulse, 83 Hawai`i 229, 244-45, 925 P.2d 797, 812-13 (1996); State v. Richie, 88 Hawai`i 19, 33, 960 P.2d 1227, 1241 (1998).

Therefore,

IT IS HEREBY ORDERED that the May 7, 2004 judgments of the district court are affirmed.

DATED: Honolulu, Hawai`i, July 26, 2005.

On the briefs:

Jon N. Ikenaga,
Deputy Public Defender,
State of Hawai`i,
for defendant-appellant.

Artemio C. Baxa,
Deputy Prosecuting Attorney,
County of Maui,
plaintiff-appellee.
