ORDER OF CORRECTION

The Summary Disposition Order of the court, filed on October 24, 2006, is hereby corrected as follows:

1. At page 3, lines 3 and 4, the word "Appellate" and "(HRAP)" should be corrected to read "Penal" and "(HRPP)," respectively, so that lines 3 and 4, as corrected, should read ". . . Hawai`i Rules of Penal Procedure (HRPP) Rules 5(c) and 7(h) (2006)."

The clerk of the court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of these changes.
