(CIV. NO. 01-1-0074)

SUMMARY DISPOSITION ORDER
(By: Watanabe, Acting C.J., Lim and Foley, JJ.)

Defendants Alice Bernades Canales and Randford Lee Canales appeal the May 12, 2003 order of the Circuit Court of the Fifth Circuit (circuit court) (1) that denied the March 20, 2003 motion they brought, pursuant to Hawai‘i Rules of Civil Procedure Rule 60(b) (2003), to set aside the circuit court's July 20, 2001 judgment and underlying order of even date granting summary judgment in favor of Plaintiff First Union National Bank.

After a meticulous review of the record and the briefs submitted by the parties, and giving careful consideration to the arguments advanced and the issues raised by the parties,

IT IS HEREBY ORDERED that the May 12, 2003 order of the circuit court is affirmed.

DATED: Honolulu, Hawai‘i, January 6, 2006.

for Defendants-Appellants.
