IT IS HEREBY ORDERED that the Summary Disposition Order of the court filed on January 24, 2006, is amended by deleting the party designation, "plaintiff-appellant pro se", of Richard A. Waters on page 5 and replacing it with "Defendant-Appellant Pro Se". In addition, the party represented by Douglas L. Halsted, "Defendant-Appellee", should be deleted and replaced with "Plaintiff-Appellee".

The Clerk of the Court is directed to incorporate the foregoing change in the original opinion.
